Terms & Conditions
The terms and conditions contained herein shall be binding on every customer of Gunsuka, LLC (THE BUYER) and shall inure to the benefit of THE BUYER and THE BUYER's successors and assigns.
Limitation of Liability
This limitation of liability shall be binding on every customer and any third party, including, but not limited to, the customer and the customer's successors, insurance carriers and any other individual or entity asserting any right or claim relating to customer's transaction with THE BUYER.
In no event shall THE BUYER be liable to any third party, including any insurance carrier. THE BUYER shall not be liable for any subrogation claim brought by customer's insurance carrier, and, by submitting an item to THE BUYER, customer expressly and specifically waives any such subrogation claim on his or her behalf as well as on the behalf of his or her insurance carrier.
THE BUYER'S liability is and shall be expressly and specifically limited to the least of the following sums:
The customer expressly acknowledges and agrees that if there is no appraisal which was issued prior to the item being submitted to THE BUYER, THE BUYER's liquidated value shall be conclusive and binding, and further, that in no event shall THE BUYER's liability exceed the sum of Five Thousand ($5,000.00) Dollars.
THE BUYER shall only be liable to a customer for a loss which occurs while an item is in the actual possession of THE BUYER. THE BUYER shall not be liable for any loss which occurs while an item is in the possession of any other party, including but not limited to, any common carrier, customs authority or postal service.
THE BUYER shall not be liable to anyone for any damages, including, but not limited to, incidental, consequential, punitive, loss of profit or opportunity, other than as set forth herein above.
By submitting the item, customer explicitly and expressly accepts this limitation of liability.
Offers of Purchase
THE BUYER will provide verbal opinions and offers at our discretion to best serve the interests of the parties. Actual offers stemming from a physical evaluation may differ from our preliminary quote based on information provided by the seller or current market conditions.
Once the purchase price offered by THE BUYER is accepted by the customer, the transaction is complete and binding upon the parties. A verbal acceptance, or electronic signature, by the customer shall result in the immediate transfer of title and ownership of the item to THE BUYER.
