Terms & Conditions

The terms and conditions contained herein shall be binding on every customer of Gunsuka, LLC (THE BUYER) and shall inure to the benefit of THE BUYER and THE BUYER's successors and assigns.

Limitation of Liability

This limitation of liability shall be binding on every customer and any third party, including, but not limited to, the customer and the customer's successors, insurance carriers and any other individual or entity asserting any right or claim relating to customer's transaction with THE BUYER.

In no event shall THE BUYER be liable to any third party, including any insurance carrier. THE BUYER shall not be liable for any subrogation claim brought by customer's insurance carrier, and, by submitting an item to THE BUYER, customer expressly and specifically waives any such subrogation claim on his or her behalf as well as on the behalf of his or her insurance carrier.

THE BUYER'S liability is and shall be expressly and specifically limited to the least of the following sums:

1. The liquidation value placed on the item in THE BUYER'S sole discretion;

2. One third (1/3) of the appraised value of the item according to an appraisal submitted by the customer to THE BUYER, which appraisal was issued prior to the shipment of the item to THE BUYER; and,

3. The sum of Five Thousand ($5,000.00) Dollars.

The customer expressly acknowledges and agrees that if there is no appraisal which was issued prior to the item being submitted to THE BUYER, THE BUYER's liquidated value shall be conclusive and binding, and further, that in no event shall THE BUYER's liability exceed the sum of Five Thousand ($5,000.00) Dollars.

THE BUYER shall only be liable to a customer for a loss which occurs while an item is in the actual possession of THE BUYER. THE BUYER shall not be liable for any loss which occurs while an item is in the possession of any other party, including but not limited to, any common carrier, customs authority or postal service.

THE BUYER shall not be liable to anyone for any damages, including, but not limited to, incidental, consequential, punitive, loss of profit or opportunity, other than as set forth herein above.

By submitting the item, customer explicitly and expressly accepts this limitation of liability.

Offers of Purchase

THE BUYER will provide verbal opinions and offers at our discretion to best serve the interests of the parties. Actual offers stemming from a physical evaluation may differ from our preliminary quote based on information provided by the seller or current market conditions.

Once the purchase price offered by THE BUYER is accepted by the customer, the transaction is complete and binding upon the parties. A verbal acceptance, or electronic signature, by the customer shall result in the immediate transfer of title and ownership of the item to THE BUYER.

Return Insurance Liabilities

Customers offering merchandise for sale to THE BUYER understand and expressly accept and agree that they will be offered the fair market wholesale value for such items. If an item is returned to a customer, THE BUYER will insure the item for no more than twice the amount offered by THE BUYER regardless of what it was insured for when mailed by the customer to THE BUYER unless THE BUYER is otherwise notified by e-mail or fax by the customer prior to the return shipment. If a customer desires to insure the item for more than twice the amount offered by THE BUYER, he or she shall in accordance with the terms and conditions forward advance payment of the sum of one hundred ($100.00) dollars to THE BUYER to cover the increased mailing, handling, insurance and administrative expenses incurred by THE BUYER. THE BUYER shall, in its sole discretion, choose the return carrier, insurance and receipt verification method for each transaction.
